DMCA & Copyright Policy

1. Overview

EAFree respects the intellectual property rights of others and expects our users to do the same. In accordance with the Digital Millennium Copyright Act (DMCA) and other applicable intellectual property laws, we will respond promptly to claims of copyright infringement committed using the Platform.

2. Reporting Copyright Infringement

If you believe that content available on or through EAFree infringes your copyright, please submit a DMCA takedown notice containing the following information: 1. A physical or electronic signature of the copyright owner or a person authorized to act on their behalf. 2. Identification of the copyrighted work claimed to have been infringed. 3. Identification of the material that is claimed to be infringing, with sufficient detail for us to locate it on the Platform (e.g., URL or description). 4. Your contact information: name, address, telephone number, and email address. 5. A statement that you have a good faith belief that the use of the material is not authorized by the copyright owner, its agent, or the law. 6. A statement, made under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or authorized to act on their behalf.

3. Designated Agent

Please send DMCA takedown notices to our designated agent: • Email: dmca@eafree.net • Subject line: "DMCA Takedown Notice" We aim to acknowledge receipt of all valid notices within 2 business days and to process takedown requests within 10 business days.

4. Counter-Notification

If you believe that your content was removed or disabled by mistake or misidentification, you may submit a counter-notification containing: 1. Your physical or electronic signature. 2. Identification of the material that was removed and the location where it appeared before removal. 3. A statement under penalty of perjury that you have a good faith belief the material was removed as a result of mistake or misidentification. 4. Your name, address, and telephone number, and a statement that you consent to the jurisdiction of the federal court in your district and that you will accept service of process from the person who filed the original DMCA notice. Upon receipt of a valid counter-notification, we will forward it to the original complainant. If the complainant does not file a court action within 10 business days, we may restore the removed content.

5. Repeat Infringer Policy

EAFree maintains a policy of terminating the accounts of users who are repeat copyright infringers. If a user receives three valid DMCA takedown notices, their account will be permanently terminated without prior warning. We may also terminate accounts after fewer notices in cases of egregious or willful infringement.

6. Good Faith & Misrepresentation

Please note that under Section 512(f) of the DMCA, any person who knowingly materially misrepresents that material is infringing, or that material was removed by mistake, may be subject to liability for damages. Do not file a DMCA notice or counter-notification unless you are certain of your claim.
